林克穎案引渡 英最快4週決定

（中央社記者劉麗榮台北17日電）外交部條約法律司長申佩璜今天說，林克穎案宣判引渡後需等蘇格蘭司法部長准駁，最快要4週後才會公布，此案上訴到二審的可能性很高。

英國商人林克穎2010年3月25日涉嫌酒駕撞死送報生黃俊德後，遭法院二審判處有期徒刑4年，2012年他冒用友人護照潛逃出境，2013年10月16日台灣與英國簽署關於林克穎引渡備忘錄。愛丁堡地方法院法官馬凱弗6月11日宣判，林克穎必須被引渡回台灣服刑。

申佩璜上午在外交部例行記者會說明，目前林克穎案需等蘇格蘭司法部長准駁，部長有8週時間可以決定，最少要考慮4週，即使此刻做了決定，最快也要4週後才能公布。

申佩璜說，若蘇格蘭司法部長公布准許引渡，林克穎才能上訴；如果不准引渡，我方也會請蘇格蘭檢察官提出上訴。他研判，這個案子上訴到二審的可能性非常高。

申佩璜說，對於林克穎案判決感到欣慰，是無邦交國家第一個引渡成功案例，也是台英司法互助的良好範例。1030617
