陸正案死囚 司改會籲非常上訴

（中央社記者蔡沛琪台北27日電）纏訟逾20年的學童陸正撕票案被告邱和順遭判處死刑定讞，民間司改會等團體今天向最高檢察署陳情，盼檢察總長提起非常上訴。

檢察總長顏大和受訪表示，將依非常上訴相關規定審視本案，依法處理。

民間司法改革基金會、廢除死刑推動聯盟、冤獄平反協會、台灣人權促進會等團體上午到最高檢陳情，由蔡瑞月文化基金會舞者演出行動劇，象徵邱和順遭屈打成招，並拿出50多名法律學者連署書，呼籲提起非常上訴。

律師尤伯祥說，本案刑求情節，比汐止吳銘漢夫婦命案被告蘇建和、前空軍士兵江國慶等案來得更明確，監察院也3度提出調查報告，呼籲顏大和能正視這起冤案。

最高法院在民國100年7月審結陸正案，維持高院更11審認定，判決邱和順死刑、褫奪公權終身定讞；同案被告林坤明17年徒刑、吳淑貞10年徒刑定讞。1030827
