漏油在路上算公共危險嗎

某地方，機車漏了一些油出來到馬路旁(我知道油氣揮發很快)

但靠近聞還是會有些許味道，請問身體不好的人，若是聞到，會有生命安全嗎?

還是不要常聞就好了?怕是老人家身體差，聞到就併發症什麼的。

還有，像這樣因為機車稍微故障的緣故而漏油在馬路邊(不會很明顯)

算公共危險罪嗎?
