前國策顧問蔡有全被控在電視節目影射民進黨立委吳秉叡「睡人妻」。高等法院日前判蔡有全4月，可易科罰金，緩刑2年確定。

判決指出，民主進步黨第8屆不分區立委提名名單出爐後，蔡有全於民國100年7月在多個電視政論節目指出，其中有一被提名人竟「睡人妻及支持者女兒」；他後來接受媒體人吳子嘉電子報專訪時，詳述是「吳姓前立委」。

吳秉叡不滿遭影射，對蔡有全提告求償。法院審理時，蔡有全說，言論自由應受憲法保障，他未公開指明是吳秉叡，沒有誹謗對方的動機。吳子嘉則作證說，蔡有全受訪時雖未指名道姓，但應是指吳秉叡。

一審法院認定，蔡有全影射說法貶抑吳秉叡道德，有極為負面評價，且證人說睡人妻的說法都是聽說的、無法證實，蔡有全事先也未合理查證，就將坊間不實傳言、風聞散布於眾，依誹謗罪判刑4月，可易科罰金。

全案經上訴，台灣高等法院日前駁回上訴，另審酌蔡有全犯後態度等，給予緩刑2年。全案確定。

民事部分，二審認定蔡有全說法造成吳秉叡的社會評價受到貶損、吳子嘉報導未盡查證義務，判決蔡、吳各賠新台幣80萬元、30萬元。(中央社)
